Refund & cancellation policy

1. Overview and nature of services

Fox CTO Advisory provides advisory and technical leadership services: technical due diligence, fractional and interim CTO engagements, AI adoption and governance, legacy modernization assessment, and AI-generated codebase rescue. These are professional services — assessment, advice, and hands-on technical work — not device repair, on-site break/fix support, or data recovery.

2. Who you are contracting with

Fox CTO Advisory, operating since 2008, principal Matthew Fox, based in Tulsa, Oklahoma. All fees are quoted and invoiced in USD.

3. Engagements are governed by a written agreement

Every engagement is defined by a signed statement of work and, where applicable, a master services agreement. Where this policy and a signed agreement conflict, the signed agreement controls.

4. Fees and payment structure

Engagements are billed as a deposit due before work commences, with the remaining balance invoiced against milestones defined in the statement of work. The deposit amount, milestone schedule, and payment terms for a given engagement are set out in that agreement, not on this page.

Invoices are issued via PayPal, via Stripe, or directly for payment by ACH, wire transfer, or check, as agreed in the statement of work.

5. Delivery and fulfillment

Deliverables — a written assessment, a roadmap, a findings readout, or ongoing advisory work — and their form are specified in the statement of work. Typical engagement durations are published on the services page. Deliverables are provided electronically.

6. Cancellation by the client

You may terminate an engagement on written notice. The deposit is non-refundable once work has commenced. Milestones not yet started are not invoiced. Work completed or in progress through the termination date is payable.

7. Cancellation by me

If I terminate an engagement, or am unable to complete it, any prepayment for work not performed is returned.

8. Refunds

Refunds are limited to:

  • Duplicate charges
  • Billing or invoicing errors
  • Payments made in error
  • Deposits where work has not yet commenced

To request a refund, email matt@foxcto.com with the invoice number and a description of the issue. Requests are reviewed within 5 business days. Approved refunds are processed to the original payment method within 10 business days.

9. Non-refundable

  • Deposits once work has commenced
  • Completed milestones
  • Delivered work product
  • Third-party costs passed through at cost

10. Dispute resolution

Contact me directly first — most concerns are resolved through direct communication. If the issue isn't resolved, submit a written complaint to matt@foxcto.com; I will review and respond in writing within 5 business days. If the matter remains unresolved, I agree to participate in mediation through a mutually agreed-upon mediator before pursuing other remedies.

11. Chargebacks

Please contact me before initiating a chargeback with your bank or card issuer — most issues can be resolved faster directly. I reserve the right to provide documentation to the payment processor to dispute unauthorized chargebacks.

12. Governing law

This policy is governed by the laws of the State of Oklahoma.

13. Changes to this policy

I may update this policy from time to time. Changes will be posted here with an updated effective date. For active engagements, the terms in the signed agreement control regardless of later changes to this page.
